LITIGATION FINANCE ADVISORY

Independent patent merits review before you fund.

Funders need a clear view of claim strength, validity risk, and the infringement read before committing capital. We provide independent technical and legal assessment of patent assertions under consideration, drawing on 25 years of patent practice that includes prosecution, PTAB proceedings, litigation support, and IP diligence for a technology company's IPO.

What we assess

Merits

The infringement read of the asserted claims against the accused products.

Validity risk

Prior art and validity exposure, including art the examiner never saw.

Claim construction risk

Terms likely to be disputed and how their construction could change the case.

Portfolio review

Which patents and claims are strongest to assert, and which carry the most risk.

Reading the full record

Funded cases often turn on a patent with a complex file history: continuation families, ex parte reexaminations, or a prior IPR. Those records are long and technical, and what the applicant or patent owner argued along the way can narrow the very claims a funder is relying on. IPR and ex parte reexamination are specialized proceedings, and hands-on experience in them is uncommon, even among patent attorneys. Our founder has drafted IPR petitions, argued before the Patent Trial and Appeal Board, and handled ex parte reexaminations, so we can tell you what the record means for claim scope before you commit.

Frequently asked questions

What do you review?

The patents, their prosecution histories, the accused products, and any prior challenges.

Can a review be done on a flat fee?

Yes. Merits reviews for funders can often be done on a flat fee, quoted once we have seen the patents and the record. Broader or ongoing work is billed on an hourly basis.

Are you independent of plaintiff's counsel?

Yes. We work for the funder, and conflicts are checked before any engagement.

Discuss your matter

A short, confidential call is the fastest way to know whether we can help. We run a conflicts check before any substantive discussion.
